GENERAL CONDITIONS OF CONTRACT FOR CONSTRUCTION WORKS (2004) (First Edition)

DEFINITIONS, INTERPRETATIONS AND GENERAL PROVISIONS

In the Contract (as hereinafter defined) the following words and expressions shall have the meanings hereby assigned to them except where the context otherwise requires: Definitions

"agreed" means agreed by the Employer and the Contractor, unless specifically otherwise stated.

"Bill of Quantities" means the document so designated in the Pricing Data that lists the items of work and the quantities and rates associated with each item to allow the Contractor to be paid at regular intervals an amount equal to the agreed rate for the work multiplied by the quantity of work completed.

"Certificate of Completion" means the certificate issued by the Engineer signifying that the whole or portion of the works have reached a state of readiness for occupation or use for the purposes intended, although some minor work may be outstanding.

"Commencement Date" means the date that the Agreement made in terms of the Form of Offer and Acceptance comes into effect.

"Construction Equipment" means all appliances or things of whatsoever nature required in or about the execution, completion or defects correction of the Works but does not include materials or other things intended to form or forming part of the Permanent Works.

"Contract" means the subject of the Agreement made in terms of the Form of Offer and Acceptance and such amendments or additions to the Contract as may be agreed in writing between the parties.

"Contract Data" means the specific data, which together with these General Conditions of Contract, collectively describe the risks, liabilities and obligations of the contracting parties and the procedures for the administration of the Contract.

"Contractor" means the natural or juristic person or partnership named in the Contract Data and whose offer has been accepted by or on behalf of the Employer and, where applicable, includes the Contractor's heirs, executors, administrators, trustees, judicial managers or liquidators, as the case may be, but not, except with the written consent of the Employer, any assignee of the Contractor.

"Contract Price" means the total of prices provided for in the Agreement made in terms of the Form of Offer and Acceptance subject to such addition thereto or deduction there from as may be made from time to time under the provisions of the Contract.
